Remodel Surge provides growth, marketing, and consulting services tailored for the remodeling and construction industries. All materials, processes, and systems are proprietary intellectual property of Remodel Surge and are protected by U.S. copyright and intellectual property laws.

2. Eligibility and Acceptable Use

By accessing our Site or Services, you confirm that you are at least 18 years of age, have full legal capacity, and are entering into this Agreement voluntarily for business purposes.

You agree to:

Not reproduce, share, or distribute any content or proprietary materials without written consent.

Not engage in chargebacks, disputes, or any actions that cause financial or reputational harm to the Company.

Violation of this section may result in immediate termination of service and legal recourse.

3. Payments and Fees

3.1 Authorization

All payments made to Remodel Surge are processed through authorized third-party providers such as Stripe, PayPal, or Whop. You agree that submitting payment constitutes full authorization to charge your payment method for the agreed amount, including renewals, add-ons, or outstanding balances.

3.2 Final and Non-Refundable Payments

All sales, retainers, and service fees are final and non-refundable.
There are no refunds, cancellations, or partial refunds under any circumstances. This includes, but is not limited to:

Dissatisfaction with service outcomes or results

Changes in business priorities or strategy

Delays in implementation caused by the client

Failure to use or apply the provided materials

Third-party issues or staffing changes

You expressly waive your right to any refund claim, reversal, or chargeback through your bank, credit card, or payment processor.

4. Chargeback and Collections Policy

4.1 No Chargebacks

By purchasing from Remodel Surge, you acknowledge and agree that all sales are final and not subject to chargebacks. Attempting to initiate a chargeback or payment dispute is considered a breach of this Agreement.

4.2 Legal and Collection Actions

If a chargeback or dispute is initiated, you agree that:

Remodel Surge reserves the right to immediately send the balance to collections.

You are responsible for all associated costs, including but not limited to:

Collection agency fees

Legal representation costs

Court costs and filing fees

Administrative and accounting fees

Interest at 2.5% per month (30% annually) on any unpaid balance

You will reimburse Remodel Surge for any and all expenses incurred while recovering the amount owed.

4.3 Legal Fee Responsibility

You agree to indemnify and reimburse Remodel Surge for all attorney fees, legal expenses, or enforcement costs that arise from any attempt to reverse, dispute, or withhold payment for services rendered.

5. Results and Performance Disclaimer

Remodel Surge provides business development and marketing strategies intended to improve client outcomes. However, results depend on numerous external factors outside our control, including your implementation, budget, sales process, and market conditions.

Accordingly, Remodel Surge makes no guarantees regarding specific revenue amounts, client acquisition numbers, or business performance outcomes.

6. Intellectual Property Rights

All systems, frameworks, designs, training materials, videos, and software tools developed or provided by Remodel Surge remain the exclusive intellectual property of the Company.

Clients receive a limited, non-transferable, non-exclusive license to use these materials solely within their own business operations. Unauthorized reproduction, resale, or sharing of content is strictly prohibited and will result in immediate legal action.

7. Limitation of Liability

To the fullest extent permitted by law, Remodel Surge and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

Use or inability to use our services

Business interruption or loss of revenue

Reliance on advice, content, or strategy provided

In no event shall Remodel Surge’s total liability exceed the total amount you paid for the service in question.

8. Indemnification

You agree to defend, indemnify, and hold harmless Remodel Surge, its officers, employees, and contractors from any and all claims, losses, damages, or expenses (including attorney’s fees) arising from:

Your breach of these Terms

Misuse of the Site or Services

Any chargeback or dispute initiated by you or your financial institution

If legal action is necessary to enforce these Terms, you agree to pay all costs of enforcement, including attorney’s fees, court costs, and related expenses.

9. Termination of Services

Remodel Surge reserves the right to suspend or terminate your access to the Site or Services at any time if:

You violate any portion of these Terms

You engage in chargeback or dispute activity

You act in bad faith or cause reputational harm to the Company

All financial obligations survive termination.

10. Governing Law and Jurisdiction

These Terms are governed by and construed under the laws of the State of New York, United States of America, without regard to conflict of law principles.

You agree that any legal proceeding or dispute shall be exclusively brought in the courts of New York County, New York, and you irrevocably submit to the personal jurisdiction of those courts.

You waive any right to participate in a class action or group proceeding against Remodel Surge.

11. Force Majeure

Remodel Surge shall not be held liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including natural disasters, internet outages, acts of war, or government actions.

12. Updates and Modifications
